 Terms & Conditions

These terms form the basis of the contract between the customer and Bing's Cakery. These Terms, your Order, and your Order confirmation are considered by us to set out the whole agreement between you and us for the sale of cakes. These terms and conditions have been designed for use within the United Kingdom and under English law.

1. Booking Process
1.1 - No contract is made with you until we have received your booking fee. Once your deposit has been received, you have agreed to the contract with Bing's Cakery and have accepted the company’s terms and condition.
1.2 - It is your responsibility to check all details in the order confirmation are complete and accurate as this is the document we work to when completing your order.
1.3 - For celebration cakes, the order process will be done via email or phone. A face-to-face design consultation can be arranged for wedding cake orders that exceed £300. 
1.4 - Ideas for the cake design can be sent when booking. We prefer to create original designs, rather than copy an existing design due to copy right laws. Therefore, we will not create exact replicas.
1.5 - You can call or email us if you need to discuss any aspects of your cake order. We aim to respond within 48 hours.
1.6 - Your order request is not guaranteed until a deposit is paid. You will then receive written confirmation of your booking.
1.7 - Percentage of the deposit will be as follows unless otherwise agreed in writing. A 25% non-refundable deposit is required for wedding cake bookings with the balance paid 14 days before the event date. 
1.8 - A 50% non-refundable deposit is required for all other cake orders. This is to be paid at the time of booking to secure your order. The Balance is to be cleared on or before the date you receive the cake. 
1.9 - Late payments will incur a £25 charge. We reserve the right to hold the order until payment is made in full. 
1.10 - Quotations are valid for a period of 7 calendar days from the day of issue. However, your booking date is not reserved until a deposit is paid.
1.11 - Cake size specifications are in inches and are based on the diameter of the cake. Standard Cakes are 3.5 to 4 inches deep. If you would like a deeper cake this needs to be requested at the time of booking. Cake boards are 3 inches larger than the cakes diameter unless otherwise specified in your booking confirmation
1.12 – please note that all cakes are made to be eaten on the day of the celebration. 

2. Allergens 
2.1 - Please advise us of any allergies or specific dietary requirements when booking your cake.
2.2 - Allergens Found in the Bing’s Cakery Kitchen: Nuts and nut by-products, eggs and egg by-Products, Milk and dairy Products, Wheat and Soya. 
2.3 - All measures are taken to reduce the risk of cross contamination with regards to Allergens. However, we cannot guarantee your cake will be allergen free, although we make every effort to ensure that allergies are accommodated.

3. Guarantee / Disclaimer 
3.1 - We do all that we can to make sure that your order is decorated to the specification on your written order confirmation. Upon pick-up or delivery of your cake, adjustments can be made for an additional charge if it was not stated on your original order. 
3.2 - If something is not decorated correctly as stated on your order, we will make necessary changes where possible free of charge
3.3 - Every order is hand-made. Decorative finishes are done by hand and are subject to the artistic interpretation of Bings Cakery. However, we make no claims for exact duplication of the work done by other cake decorators.
3.4 - If certain materials required for your cake design become unavailable, we will do our best to select replacement products to reflect the original design as closely as possible without notice.
3.5 - Where colour swatches are provided, we will do our best to match as close as we deem possible. Exact colour matches are not guaranteed. Bings Cakery cannot match a “verbal” colour or a colour sent via electronic devices, as all monitors display colour differently. 
3.6 - Fresh flowers are not included in the price of any cake design. If a cake is to be dressed with fresh flowers and are provided by the florist it is the florists responsibility to decorated your cake. Bings Cakery will supply an undecorated cake ONLY as agreed by contract and therefore is not responsible for the finished design once set up at venue is completed. 
3.7 - If you would like Bings Cakery to arrange the flowers on your cake, we will supply the flowers and charge accordingly for this service and provide a separate invoice. 
3.8 - Some flowers are not suitable for use as a cake decoration. Ask your florist for details regarding toxicity. We cannot be liable for any contamination of our food products that may arise from their misuse. 
3.9 - Stacked cakes contain dowels in each tier to provide support and these should be removed before consumption. These must be used to prevent tiered cakes collapsing. Requests for stacked cakes to be made without dowels will be declined. 
3.10 - If your cake contains figures/models made from sugar paste, we do not advise that they be eaten due to the presence of dowels or cocktail sticks for reinforcement. 
3.11 - All of our figures are handmade, we try to capture the characteristics of a particular person if requested (such as with Hair colour, hair Length, eye colour, facial hair etc), we cannot guarantee a true likeness. You must provide images for our reference if you require a more personalised model. 
3.12 - Where images are not provided standard figures shall be used. Images are to be provided no later than 6 weeks prior to the order due date.
3.13 - Bing's Cakery and the customer expressly agree that the cakes and all goods purchased from the Company remain the property of Bing's Cakery until paid for in full.
3.14 – Bings Cakery reserve the right to make design and structural changes to your cake to maintain stability without prior notice. 
3.15 – Once cakes are set up at your venue, they are not indented to be moved until served. It is not our responsibility for any damages caused by third parties if this happens. 

4. Cancellation and requests to reschedule 
4.1 - Cancellations due to government restrictions regarding the Covid-19 pandemic will be entitled to a refund minus the non-refundable deposit or a transfer of booking to a future date with no extra fee. Cancellations must be made in writing to: Bingscakery@outlook.com with at least 21 days notice. This policy only applies to cancellations due to the event not being able to take place by law. It excludes wedding party/guest’s inability to attend due to Covid 19. 
4.2 - If you reschedule your wedding for any reason and 30 days notice is given, we will try to accommodate your new date, but if we are unable to do so, your deposit payment is non-refundable. Gift vouchers for future orders will be provided instead. Deposits are non-transferable if requests to reschedule is less than 30 days notice. 
4.3 - Rescheduling celebration cakes, deposits are non-refundable without exception. The option to transfer the deposit to another date will be at Bing's Cakery discretion only. 
4.4 - Postponements may also be subject to an increase in costs, in line with the annual cost of inflation, dependant on the duration of the postponement. Any further postponements will be classed as a cancellation.
4.5 - If for any reason you fail to collect your cake order, we reserve the right to take action to recover any balance outstanding.
4.6 - Requests for refunds or cancellations due to venue cancelling your event will not be honoured. We strongly advise you take out a wedding insurance policy to claim back monies paid.

5. Delivery and Collection
5.1 - All orders may be collected free of charge by prior arrangement by the client or an appointed person. We accept no responsibility for any damage sustained to the cake once it has left the premises.
5.2 - If delivery is requested, we will deliver the cake on the date agreed to the address provided. We do not offer specific delivery times. If the delivery address changes after the orders been confirmed, additional charges may be added to cover extra mileage and fuel costs.
5.3 - We will arrange the delivery and set up time with your venue for wedding cake orders. We will take a photograph of the cake before leaving and, where possible, obtain a signature from the venue confirming the cake has been received in good condition. Once the cake has been delivered, we are unable to accept any liability for any damage sustained to the cake by any third party
5.4 - All products are the responsibility of the customer once it leaves our premises or upon delivery. We are not responsible for any damage occurring to the cake during transport or set-up. You will be given instructions on how to carry, transport, and store your cake. Cakes are very fragile and damages can happen if not handled properly.
5.5 - Cakes should be stored in a dry place, at room temperature, away from direct sunlight and sources of heat. They should be kept in the box provided before serving. They should NOT be refrigerated unless otherwise instructed to. They should not be left in a vehicle when the temperatures are either hot or cold. Bings Cakery accept no liability for incorrect storage once in the customers possession.
5.6 – Bing’s Cakey does not accept liability for damage caused to your cake order if courier services are used. Complaints regarding failure of delivery or damaged items will not be accepted. Costs must be raised with the courier service used. 
5.7 – A delivery date and time will be agreed by both parties. If the client is not at the location as agreed, and we are not able to contact the client, the product will be transported back to our premises and it will be the responsibility of the client to collect the product at their own cost. 

6. Cake stand hire
6.1 - A security deposit will be payable with the final balance along with a hire fee. The stand must be returned to us in a good, clean condition within 3 days of the wedding. Upon the return of the stand, the deposit will be refunded. 
6.2 - If the stand is returned broken or damaged, the cost of the replacement stand will be deducted from the security deposit. Please note that most security deposits are calculated based on how much it would cost to replace the stand. 

7. Social media and advertising
7.1 - We reserve the right to use images of your cake order for any form of advertising. 
7.2 - Where photo prints have been used, permission will be requested in writing before use. If you withdraw consent, we will not use your images on any social media site or website. 
7.3 – You have the right to withdraw consent regarding the use of edible photo print orders at any point. 

8. Complaints/Refunds/Returns
8.1 - Please note we can only deal with the client who placed the original order.
8.2 - We must be notified of any complaints immediately and no later than 24 hours of receiving your order.
8.3 - The complaint must be made in writing via email to: Bingscakery@outlook.com 
8.4 - The cake and any portions need to be returned for testing and further investigation within 24 hours. It is the responsibility of the customer to return the cake at their own cost and to collect the cake after testing the following day. The cake will be disposed of within 24 hours if not collected by the customer. 
8.5 - Refusal to collect the cake after analysis is not deemed a return, cakes cannot be resold and will be past their best once they are cut. Therefore, they are not returnable for a refund. 
8.6 - Our cakes are fresh product containing no additives or preservatives and it is our right to assume consumption on the day requested. Therefore, the best before end will be the date you receive your order. 
8.7 - All claims for refunds will only be entertained if received in writing and at least 75% of the cake is returned within 24 hours of collection or delivery. 
8.8 - Cake flavour and texture are subjective. Refund requested due to flavour or texture will NOT be honoured. 
8.9 - Please note that we cannot issue refunds or credit for cakes that have already been completely eaten. 
8.10 - Complaints regarding the decoration of celebration cake must be raised upon delivery/collection to give us the opportunity to correct them. Once payment has been made, this confirms that the decoration is as requested, and no further claims can be made regarding the appearance of your order.
8.11 - Both Parties agree to not post any negative information about the other arising out of this Contract or Event on social media or websites without providing written notice of the intended content and providing the other party with the opportunity to resolve any issues between the parties amicably.
8.12 - If the cake does not meet your expectations at time of delivery or collection, we will give you a refund (minus 25% handling/cancellation fee). This refund will be given as a credit (no cash/money refunds will be given).
8.13 - Please note, if we give you a refund of any nature, you cannot keep the cake. You can only get the refund if you refuse to “accept” the cake order at the time of delivery or collection. Refunds will only be considered if the issue regarding decoration is not easily resolved.
 8.14 - The maximum refund we offer is the value of the cake. This is at Bings Cakery's discretion only. Further compensation is not available.
8.15 - Customers shall not make any charge backs to the Company's bank account or PayPal account without Company's prior written consent. The client is responsible for any fees associated with recouping payment on charge backs and any collection fees associated with this.

9. Protecting our staff
9.1 - We understand that customers can become frustrated with matters out of their control that do not proceed as they anticipated. However, abusive or aggressive behaviour towards Bing’s Cakery staff will not be tolerated.
9.2 - Abusive or aggressive behaviour towards staff will result in your complaint being declined with immediate effect. 
9.3 - Aggressive or abusive behaviour includes any language (whether verbal or written) that may cause staff to feel afraid, alarmed, threatened or abused. This may include threats, personal verbal abuse, rudeness, derogatory remarks, remarks of a racial or discriminatory nature and unsubstantiated allegations.
9.4 - Bing’s Cakery reserve the right to remove abusive or aggressive customers from social media accounts and email accounts. 
9.5 - Bing’s Cakery also reserve the right to cease contact/communication with clients who become aggressive, abusive or display unreasonable behaviour. This applies to before receiving your order, during the order process and after accepting the order.

10. Our right to end your contract
10.1 - If we are unable to supply your order due to events outside of our control.
10.2 - We have not received payment of your order in line with the agreement on your order confirmation.
10.3 - We are no longer able to provide you with your order due to supply issues.
10.4 – You contract will be ended for reasons outlined in section 9 (Protecting our staff).
10.5 - Where we cancel the booking due to illness or any other unforeseen circumstances the deposit and all monies will be refunded within 7 days.
